1. Acceptance of these terms
These Terms & Conditions ("Terms") govern your access to and use of the Sehat Planet website, portals, chat assistant and related services (together, the "Platform"), operated by Make My Health International Private Limited, C 3345, 2nd Floor, Green Fields Colony, Faridabad 121003, Haryana, India ("Sehat Planet", "we", "us" or "our").
By browsing the Platform, creating an account, or submitting a booking or enquiry, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use the Platform. If you use the Platform on behalf of an organisation, you represent that you are authorised to bind that organisation to these Terms.
2. What Sehat Planet is (and is not)
Sehat Planet is a discovery and booking marketplace. We connect people seeking Ayurveda and Naturopathy based wellness care with independent retreats, clinics and hospitals ("Partners") that list their centres and programs on the Platform.
We are not a hospital, clinic, medical practitioner or healthcare provider. All treatments, therapies, consultations and programs are provided solely by the Partner you book with, under their own professional responsibility, licences and registrations. Any contract for the provision of a wellness program is formed directly between you and the Partner.
3. Medical disclaimer
Content on the Platform, including condition pages, guides, blog articles, audio books, testimonials and chat assistant responses, is provided for general information and education only. It is not medical advice, diagnosis or treatment, and it is not a substitute for consultation with a qualified medical professional.
- Always seek the advice of a qualified physician or practitioner regarding any medical condition before starting, changing or stopping any treatment or program.
- Never disregard professional medical advice or delay seeking it because of something you have read or heard on the Platform.
- Results described in stories, testimonials or program pages vary from person to person and are not guaranteed.
- In a medical emergency, contact local emergency services immediately. The Platform is not designed for emergencies.
4. Eligibility and accounts
You must be at least 18 years of age to create an account or make a booking. Bookings for minors must be made by a parent or legal guardian.
You agree to provide accurate, current and complete information when registering and to keep it updated. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us immediately at info@sehatplanet.com if you suspect unauthorised use of your account.
We may suspend or terminate accounts that provide false information, breach these Terms or misuse the Platform.
5. Bookings, pricing and payments
- A booking request submitted through the Platform is an enquiry to the Partner, not a confirmed reservation. A booking becomes confirmed only when the Partner accepts it, which will be reflected in your account and/or communicated to you.
- Program details, availability, inclusions and prices are provided by Partners and may change. The price shown at the time of booking, as confirmed by the Partner, applies to your booking.
- Unless expressly stated otherwise on the Platform, payment for programs is made directly to the Partner under the Partner's own payment terms. Any taxes applicable to the program are as communicated by the Partner.
- You are responsible for reviewing program details, eligibility requirements and any health prerequisites before booking, and for disclosing relevant health conditions to the Partner.
- Travel, accommodation outside the program, insurance and personal expenses are your responsibility unless the program explicitly includes them.
6. Cancellations, rescheduling and refunds
Cancellation, rescheduling and refund terms are set by each Partner and may vary by program. Please review the Partner's terms before booking, or contact the Partner or our support team for clarification.
- To cancel or reschedule a booking, use your account dashboard or contact us at info@sehatplanet.com with your booking details.
- Refunds, where applicable, are processed by the party that collected the payment, on the timelines communicated to you.
- Partners may cancel or modify a booking due to circumstances such as practitioner unavailability or safety concerns; in such cases you will be offered an alternative date or a refund of amounts paid in accordance with the Partner's policy.
- Sehat Planet may assist in facilitating resolution of cancellation or refund disputes but is not liable for amounts paid directly to Partners.
7. Partner obligations
Partners listing centres or programs on the Platform additionally agree that they:
- Hold and maintain all licences, registrations, qualifications and insurance required to lawfully provide their services, including applicable AYUSH and clinical establishment registrations.
- Will provide accurate, complete and non-misleading information in their onboarding details, listings and program descriptions, and keep them up to date.
- Are solely responsible for the quality, safety, legality and delivery of their services and for the conduct of their staff and practitioners.
- Will use customer information received through the Platform only to fulfil bookings, keep it confidential, and comply with applicable data protection law.
- Will not solicit customers to transact off-Platform in order to circumvent the Platform, while a booking initiated on the Platform is active.
- Acknowledge that listings and programs are subject to review and approval by Sehat Planet, and may be edited, unpublished or removed for breach of these Terms or applicable law.
8. Acceptable use
You agree not to:
- Use the Platform for any unlawful, fraudulent or harmful purpose, or in violation of any applicable law.
- Impersonate any person or entity, or misrepresent your affiliation with any person or entity.
- Submit false bookings, fake reviews or misleading enquiries.
- Upload or transmit viruses, malware or any code designed to disrupt or damage the Platform.
- Scrape, crawl, harvest or copy data from the Platform, or use automated systems to access it, without our prior written consent.
- Attempt to gain unauthorised access to any part of the Platform, other users' accounts, or our systems.
- Post or transmit content that is defamatory, obscene, hateful, infringing or otherwise objectionable.
9. Intellectual property
The Platform and its content, including the Sehat Planet name and logo, text, graphics, design, condition guides, audio content, software and compilations, are owned by or licensed to Make My Health International Private Limited and are protected by copyright, trademark and other intellectual property laws.
We grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Platform for personal, non-commercial purposes. You may not reproduce, distribute, modify, create derivative works of, publicly display or commercially exploit any content from the Platform without our prior written permission.
Content submitted by Partners (such as photographs, descriptions and documents) remains the Partner's property; by submitting it, Partners grant us a worldwide, royalty-free licence to host, display, reproduce and promote it in connection with the Platform.
10. Third-party links and services
The Platform may contain links to third-party websites and services, including Partner websites, payment services and event registration pages. These are provided for convenience only. We do not control and are not responsible for the content, policies or practices of third parties, and a link does not imply endorsement.
11. Disclaimers
The Platform is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement.
While we take reasonable steps to verify Partners at onboarding, we do not warrant or guarantee the quality, safety, effectiveness or outcomes of any Partner's services, the accuracy of Partner-provided information, or that the Platform will be uninterrupted, secure or error-free.
12. Limitation of liability
To the fullest extent permitted by applicable law, Sehat Planet, its directors, officers, employees and agents shall not be liable for any indirect, incidental, special, consequential or punitive damages, or for loss of profits, data, goodwill or business opportunity, arising out of or in connection with your use of the Platform or any Partner's services.
Our total aggregate liability for any claim arising out of or relating to the Platform or these Terms shall not exceed the greater of (a) the platform fees, if any, actually paid by you to Sehat Planet in the six months preceding the claim, or (b) INR 10,000.
Nothing in these Terms limits liability that cannot be limited under applicable law, including liability for fraud.
13. Indemnity
You agree to indemnify and hold harmless Sehat Planet and its affiliates, directors, officers and employees from and against any claims, liabilities, damages, losses and expenses (including reasonable legal fees) arising out of or connected with your breach of these Terms, your misuse of the Platform, your violation of any law or third-party right, or, if you are a Partner, the services you provide.
14. Suspension and termination
You may stop using the Platform and request deletion of your account at any time. We may suspend or terminate your access, or remove listings and content, with or without notice, if we reasonably believe you have breached these Terms, pose a risk to other users, or where required by law.
Provisions that by their nature should survive termination, including Sections 9 and 11 to 16, will survive.
15. Governing law and dispute resolution
These Terms are governed by and construed in accordance with the laws of India. Subject to any mandatory consumer protection rights you may have, the courts at Faridabad, Haryana shall have exclusive jurisdiction over disputes arising out of or in connection with these Terms or the Platform.
We encourage you to contact us first so we can attempt to resolve any concern amicably through our grievance process described in Section 17.
16. Changes to these terms
We may revise these Terms from time to time. The "Last updated" date at the top of this page indicates when they were last changed. Material changes will be notified through the Platform or by email. Your continued use of the Platform after changes take effect constitutes acceptance of the revised Terms.
